    How wrong is that?

    So lets think of another scenario.... crowd of people watching two men arguing about a car parking space......one of the men (lets say the one in the wrong) calls him a twat the other one head butts him. Should he be let off because the baiting was to blame. !!

    The point is that the Jeremy Kyle show is highly organised baiting - its pre-arranged and puts people in highly emotional situations where they react for the pleasure of watching viewers and the studio audience. An incident that happens suddenly in a car park is not even similar. I think the judge was quite right considering the circumstances.

    he wasn't let off, he got fined. He was put in that position by the producers - essentially by being lied to, he thought he was there to reconcile with his wife.

    The people responsible for this, namely the producers, should in my opinion be in the dock with you Mr Staniforth.

    It's regrettable that some newspapers continually write as though there is nothing in between 'prison sentence' and 'no punishment whatsoever'.

    It's regrettable that many people swallow that line.

    If you think everybody should be either 'let off' or imprisoned, write to your MP. The law would need to be changed so that the multitude of creative sentencing options are withdrawn, and we'll also need to spend a £billion or two building more prisons.

    Provocation has ALWAYS been a mitigation for a crime of battery. The level of the provocation affects the degree to which there is mitigation for the offence and therefore the appropriate sentence. There are also aggravating factors which, if present, will increase the severity of the sentence.
