    I'm failing to see why it's discrimination when it's for a photoshoot. Fair enough if I was asking for programmer or a plumber etc etc and specified pale skin only, that would be discriminating but this is totally different.

    I notice that the Ceroc Champs OLD GITS catogary had been changed to CEROC VETS. There is a 45 year old minimum age. Is this youth descrimination?

    I was talking to a bloke at Hammersmith freestyle on Saturday who told me that the Seniors want their own 'Lucky Dip'. They are not keen to enter the Lucky Dip as it attracts young dancers.

    DS is correct to an extent - even the old Race Discrimination legislation contained a "theatrical" exception, which permitted discrimination where effectively it was an essential for the role - e.g. where the role was for - for instance a character who had to be portrayed as a coloured character, then it would not be illegal discrimination to exclude non-coloured actors from the casting process for that particular role. (Disclaimer - I haven't checked the recent amendments, but I would imagine that there is a similar provision in the current version of the legislation)

    As far as age discrimination goes, I thought I would try and inform the debate by giving the full definition. The relevant legislation is the Employment Equality (Age) Regulations 2006 (as amended). A link to the unamended legislation (I haven't been able to track down a fully amended version online) is here.

    Discrimination in terms of these regs (Reg3) is:

    "Discrimination on grounds of age
    3. —(1) For the purposes of these Regulations, a person ("A") discriminates against another person ("B") if—

    • (a) on grounds of B's age, A treats B less favourably than he treats or would treat other persons, or

      (b) A applies to B a provision, criterion or practice which he applies or would apply equally to persons not of the same age group as B, but—
      • (i) which puts or would put persons of the same age group as B at a particular disadvantage when compared with other persons, and

        (ii) which puts B at that disadvantage,
    and A cannot show the treatment or, as the case may be, provision, criterion or practice to be a proportionate means of achieving a legitimate aim.


    • (2) A comparison of B's case with that of another person under paragraph (1) must be such that the relevant circumstances in the one case are the same, or not materially different, in the other.

      (3) In this regulation—
      • (a) "age group" means a group of persons defined by reference to age, whether by reference to a particular age or a range of ages; and

        (b) the reference in paragraph (1)(a) to B's age includes B's apparent age."
    Hope it isn't spoiling the fun, but I thought if we are going to have an argument, I'd try and make it an informed argument.

    As you can see there is a "proportionate means of achieving a legitimate aim" defence. So, I suppose that someone wanting to employ child - or appropriately young-looking - to portray the role of a child or young person to exclude actors who did not look appropriately young from the casting process for that role would not be acting illegally. Or at least I sincerely hope they wouldn't be.
